Terms of Service

1. Agreement

These terms are a contract between you and Bharat Mechanics Private Limited ("Bharat Tracker", "we") for the use of our website, mobile apps, school and fleet dashboard, and GPS devices (the "Service"). By creating an account or using a device we supplied, you accept them. If you use the Service for an organisation, you confirm you may bind it.

2. Accounts and roles

Accounts are personal to the person or organisation they are issued to.

• Keep your login and OTPs private; you are responsible for activity on your account.
• Organisation administrators are responsible for the users, drivers and parents they add and for the accuracy of the vehicle and student data they enter.
• Parents may only follow children their school has linked to their mobile number.

3. Subscriptions and payment

Paid plans are billed per vehicle, monthly or annually, in advance and in Indian Rupees plus applicable GST. The Starter plan is free for one vehicle. Prices are quoted per fleet and may change with 30 days' notice; changes never apply mid-term to a prepaid period. Unpaid invoices may result in suspension after a reminder.

4. Hardware

GPS trackers, NFC readers and relays are sold to you and become your property on payment; the software on them remains ours and is licensed for use with the Service. Installation is performed by our network. Devices carry a 12-month replacement warranty against manufacturing defects; damage from accidents, tampering, water ingress or removal by others is excluded. Do not open or modify a device.

5. Acceptable use

You agree not to:

• Track a vehicle you do not own, operate or have documented authority over.
• Use the Service to follow or harass a person.
• Attempt to reverse-engineer, scrape, overload or bypass the security of the Service.
• Enter data about children without the authority of their guardians and school.

6. Remote engine cut-off

Cut-off immobilises a vehicle and is a safety-critical feature. It is available only on devices fitted with a relay by our technicians, applies only when the vehicle is stationary or at crawling speed, and requires confirmation in the app. You are responsible for using it lawfully and only on vehicles you control. Every command is logged with the sending user and time.

7. Service levels and support

We aim for 99.9% platform availability but the Service depends on mobile networks and GPS satellites we do not control; live positions can be delayed or unavailable where coverage is poor. Support is available 24×7 by phone and email. Alerts are aids to supervision, not a replacement for it — schools and operators remain responsible for the safety of their passengers and vehicles.

8. Data

How we handle personal and vehicle data is set out in our Privacy Policy, which forms part of these terms. You retain ownership of your data; you grant us the rights needed to operate the Service, and you can export or delete it as described there.

9. Termination

You may cancel at the end of any billing period. We may suspend or end access for non-payment or a breach of section 5 after notice, or immediately where safety or the law requires. On termination, your data is handled per the retention rules in the Privacy Policy.

10. Liability

To the extent permitted by Indian law, the Service is provided as described and our total liability for any claim in a year is limited to the fees you paid us in that year. We are not liable for indirect losses such as lost profits, or for loss caused by network outages, incorrect data entered by you, or vehicles operated in breach of these terms. Nothing limits liability that cannot be limited by law.

11. Governing law and contact

These terms are governed by the laws of India; courts at Chandigarh have exclusive jurisdiction.
